Why your old template is now a legal risk

The Renters' Rights Act rewrote tenancy law in England. Most agreements floating around the internet were written for a law that no longer exists.

Fixed terms are an offence

Every new tenancy must be periodic. Offering a "12-month AST" can now mean fines of up to £7,000 and rent repayment orders.

Can I still use my old AST template?

No. Assured shorthold tenancies were abolished on 1 May 2026. New tenancies must be assured periodic tenancies - and offering or demanding a fixed term is now an offence. Agreements need different clauses on rent, notice and possession.

What is an assured periodic tenancy?

A rolling tenancy with no end date. It runs month to month until your tenant gives two months' notice, or you recover possession using one of the legal grounds under Section 8. Section 21 "no-fault" evictions no longer exist.

Exactly what do I receive?

A tenancy agreement personalised with your property, rent, deposit and tenant details; the government information sheet you may need to give your tenant; and a checklist covering deposit protection, gas safety, EPC and the other documents the law requires. PDF and Word formats.

Is this legal advice?
